Purpose

The remote desktops provided are to be used exclusively for delivering training, consultancy services, or recruitment activities.

Non-permitted use

You may not use the service for the following:

1. Hosting websites or other services
2. Bitcoin mining
3. Conducting performance tests

If our team detects any unauthorised activity, the service will be terminated immediately and no refund will be given.

 

Guarantee and Service Layer Agreement

DaDesktop guarantees 95% service availability.

Maintenance, repairs, and upgrades will be carried out outside the hosted working hours of 8 am to 8 pm local time (the time zone where the server is physically located).

 

Data Safety and Confidentiality

The service is provided on an as-is basis, and DaDesktop cannot ensure the confidentiality or security of any data copied onto the desktops. If you need such assurances, we recommend using DaDesktop On-Premise instead.

Given that the desktops are mainly intended for training, this service is not appropriate for handling highly confidential materials.

Authentication for the remote desktops prioritises ease of use over security.

Troubleshooting Recording

Course Desktops (including Fresh-start, Trainer, and Participant varieties) may be recorded for troubleshooting purposes.

Disclaimers of Liability - Indemnification

DaDesktop PROVIDES THE SERVICES ON AN "AS IS" BASIS, WITH ALL FAULTS AND AS AVAILABLE. NEITHER WE NOR OUR SUPPLIERS OFFER ANY EXPRESS OR IMPLIED WARRANTIES OR GUARANTEES REGARDING THE SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE AND OUR SUPPLIERS DO NOT GUARANTEE THAT THE RESULTS OBTAINED FROM USING THE SERVICES WILL BE EFFECTIVE, RELIABLE, ACCURATE, OR MEET YOUR REQUIREMENTS. WE DO NOT GUARANTEE THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICES (WHETHER DIRECTLY OR THROUGH THIRD-PARTY NETWORKS) AT THE TIMES OR LOCATIONS YOU CHOOSE. NO ORAL OR WRITTEN INFORMATION PROVIDED BY A DaDesktop REPRESENTATIVE SHALL CREATE ANY WARRANTY. YOU MAY HAVE ADDITIONAL CONSUMER RIGHTS UNDER YOUR LOCAL LAWS IN Hong Kong THAT THIS CONTRACT CANNOT CHANGE. YOU USE THE SERVICES AT YOUR OWN RISK.

YOUR ONLY AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US OR OUR SUPPLIERS IS TO CANCEL YOUR ACCOUNT. UNDER NO CIRCUMSTANCES SHALL THE AGGREGATE AND CUMULATIVE LIABILITY OF US, OUR AFFILIATES, AND OUR SUPPLIERS TOWARDS YOU FOR ANY CLAIMS RELATED TO THE USE OF THE SERVICES EXCEED THE TOTAL FEES YOU PAID, IF ANY, DURING THE PERIOD IN WHICH THE CLAIMS AROSE. NEITHER WE, OUR AFFILIATES, NOR OUR SUPPLIERS SHALL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
